Description

This is an execution sent to the Miller County sheriff to collect court fees from James Garner to give to Polly Hillhouse.

Biographical/Historical Note

Polly Hillhouse, wealthy widow of Eli Hillhouse, won a lawsuit against James Garner in 1824. The court ruled that Garner owed Hillhouse $8.25. However, Garner evidently was no longer a resident of Lawrence County by the time the verdict was rendered. This execution was sent to the sheriff of Miller County, where Garner was believed to reside, instructing the sheriff to collect the money owed to Hillhouse. Interestingly, this pre-printed execution form was created by William Woodruff of Little Rock, owner of the Arkansas Gazette.

To the Sheriff of the County of Miller Greeting:
whereas Polly Hillhouse
at our Circuit Court, before
our Judge hath recovered against James Garner
the sum of eight dollars and
twenty five cents [crossed out]
which to the said Polly Hillhouse
were adjudged for her costs in
that suit expended, as appears to us of record: These are therefore to command you, that, of the goods and
chattels, lands and tenements of the said James Garner
you cause to be made the aforesaid
costs, and that you have the same before the Judge
of our said Court on the first Monday of March next, to render to the said Polly
Hillhouse the
costs aforesaid. And for want of sufficient goods an
chattels, lands and tenements, whereon to levy and make the same, we command that you take the said
James Garner
if he be found in your bailiwick, and him safely keep so that you have his body before
the same Judge, on the said first Monday of March to satisfy the said
Polly Hillhouse of the aforesaid
costs; and that you certify to our Judge
how you execute this writ, and have you then there this writ.
In testimony whereof I have hereunto set my hand as Clerk, and
affix the seal of office this 6th day of December 1824, and of the
Independence of the United States the 49th year
