Description
This is the motion filed by the defense claiming that the case be thrown out because the prosecuting attorney was not a sworn county official.
Biographical/Historical Note
In response to the indictment, Jarrett's two attorneys filed this motion attacking the authority of the prosecuting attorney. It's a move that could have gotten the case thrown out on a technicality had it succeeded.

United States v. Jaret[sic]: The attorneys for the
defendant come
in to court and pray that
the judgement[sic] in this
case be arrested for the following
reasons 1st it dose[sic] not appear from the record that Samuel Hale
prosecuting attorney was sworn
and has taken the requisite oaths
of office. 2 he has not prodused[sic] his
commission nor dose[sic] it appear by
what authority his signs himself prose-
cuting attorney
